1. Scope
These Terms of Service apply to the use of the FindAShoot platform (hereinafter "Platform"). By registering or using the Platform, the user accepts these Terms.
2. Services
FindAShoot is a matching and listing platform connecting models, photographers, videographers, make-up artists and brands. The Platform provides (i) profile visibility, (ii) booking inquiries, (iii) an encrypted messaging system, and (iv) the ability to create and discover four kinds of listings: castings, events, workshops and model-sharing sessions.
FindAShoot is not the organiser, host, ticket seller or payment intermediary of any listing. All agreements concerning payment, logistics, content, safety and execution of a listing are concluded exclusively between the users involved. No payment processing takes place through the Platform.
For paid listings (e.g. workshop tickets, model-sharing slot fees), the organiser is solely responsible for any consumer-protection obligations under applicable law (pre-contractual information, right of withdrawal, refunds in case of cancellation).
3. Registration and User Account
Registration is free. A verified account may be required for certain features.
Users are obliged to provide truthful information and to keep their password confidential.
The Platform reserves the right to suspend or delete accounts in case of violation of these Terms.
4. User Conduct and Content
Users are solely responsible for the content they post.
It is prohibited to publish unlawful, discriminatory, harassing, or explicitly sexual content.
Nudity and explicit content are not permitted without express approval from the platform operators.
External links in profile descriptions are not allowed.
The Platform reserves the right to remove content that violates these rules.
5. Messaging and Safety Monitoring
Users may communicate with each other through the Platform's messaging system. These communications are intended to remain private between users.
However, to ensure the safety and integrity of the Platform, the operator reserves the right to review messages strictly in the following cases:
• when a user reports a conversation or message,
• when there is a reasonable suspicion of misuse, abuse, or violation of these Terms,
• when required by applicable law or legal authorities.
The Platform does not actively monitor all communications and does not routinely access private messages.
By using the messaging system, users acknowledge and agree that messages may be accessed and reviewed under the conditions described above.
6. Disclaimer and limitation of liability
The Platform is not liable for the accuracy or completeness of user content.
Agreements between users (e.g. bookings, fees, tickets, slot fees) are concluded outside the Platform and are the sole responsibility of the parties involved.
The Platform expressly disclaims liability for: physical or psychological harm sustained during meetings or shoots, loss or damage of equipment, infringement of image or personality rights between users, cancellation or non-performance of any casting, event, workshop or model-sharing session, and content that third parties publish or distribute after a meeting has ended.
To the extent permitted by law, the Platform's total aggregate liability to any user arising out of or related to the use of the Platform is limited to the greater of (a) EUR 100, or (b) the total amount the user actually paid to FindAShoot in the 12 months preceding the event giving rise to the claim. This limitation does not apply in cases of wilful misconduct or gross negligence by the Platform, nor to liability that cannot be excluded by law (e.g. personal injury, product liability, mandatory consumer-protection rules).
7. Indemnification
The user shall indemnify and hold harmless the Platform, its operators, employees and agents from any third-party claims, demands, losses, damages, costs and expenses (including reasonable attorney's fees) arising out of or related to: (a) content the user publishes, (b) participation in or running of any casting, event, workshop or model-sharing session, (c) the user's breach of these Terms, (d) infringement of any third-party rights — in particular image, personality, copyright or data-protection rights, or (e) other conduct of the user outside the Platform.
8. Amendments
The Platform reserves the right to amend these Terms at any time. Material changes will be communicated to users by email or through the Platform. Continued use after changes constitutes acceptance.
9. Governing law, jurisdiction and prevailing language
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Jurisdiction is Vienna.
Mandatory consumer-protection rules of the user's country of residence remain unaffected to the extent they are more favourable to the user.
These Terms are published in several languages. In case of discrepancy between the language versions, the German version shall prevail.
10. Identity verification and content moderation
Identity verification is voluntary. Users may request it by uploading a selfie plus a photo of a valid ID. Only authorised admins review the submission; the files are deleted within 7 business days of approval or rejection.
Photos, profiles and castings are reviewed by our admin team before going public. Moderation is performed by humans — no automated decision-making alone determines account status.
Automated pre-screening is limited to technical checks (image format, obvious duplicates). Every action that affects visibility — approval, rejection, account suspension — is reviewed by a human.
User reports are triaged within 48 hours. Users affected by a moderation action are notified with the reason. Under the EU Digital Services Act users have the right to appeal moderation decisions by contacting support@findashoot.com.
Sanctions escalate proportionally: warning → content removal → temporary account suspension → permanent ban, depending on the severity and repetition of the violation.
11. Copyright — DMCA (United States)
For US users and rightsholders, FindAShoot complies with the Digital Millennium Copyright Act (17 U.S.C. § 512).
DMCA notices must be sent to support@findashoot.com (subject: "DMCA notice") with the elements required by 17 U.S.C. § 512(c)(3): identification of the copyrighted work, identification of the allegedly infringing material and its URL, your contact details, a good-faith statement, and a statement under penalty of perjury that you are authorised to act for the rightsholder.
If your content has been removed and you believe the removal was mistaken, you may submit a counter-notice to the same address as required by 17 U.S.C. § 512(g).
Repeat infringer policy. Accounts of users who receive multiple substantiated copyright takedown notices will be suspended and, in case of repetition, permanently terminated.
Knowingly false notices or counter-notices may incur liability under 17 U.S.C. § 512(f).
